An Albuquerque family says there's been another setback in trying to find justice for their murdered son.
Two men charged with the crime may have the murder charges against them dropped.
It's been more than a year, since Aaron Ferrell, 17, was shot in the back and killed at Mariposa Park in Taylor ranch. Two brothers, Linh and Tam Nguyen, were later arrested for the crime.
However the district attorney's offices believes Ferrell's' murder is far from being solved.
Ferrell's family met with prosecutors today for a status meeting on the upcoming trial for the Nguyens.
They learned that the brothers may not be tried on murder charges because investigators said there isn't enough evidence to prove who fired the shot that killed Ferrell.
The family told News 13 that prosecutors are recommending that the Nguyens only be charged with firing a gun from a moving vehicle.
"That's the only charge they feel they can get right now," Ferrell's cousin Carla Serna Darling said. "Basically all the other charges, the first degree murder charges, the tampering with evidence, the hiding the gun, they've all been dropped."
Chief Deputy District Attorney Todd Heisey would not specify just what took place inside today's closed meeting.
But he did say that official word of any charges being dropped must come from District Attorney Kari Brandenburg, and she's out of town.
No other suspects for have been named in the case.
Investigators said Ferrell and some his friends were planning to fight the Nguyens and their friends. That's when the shots were fired.
