Businessman faces federal porn charges

State statute of limitations had run out

ALBUQUERQUE (KRQE) - A prominent Albuquerque businessman was taken into federal custody Wednesday on charges he recorded himself sexually assaulting a child for more than a decade.

"This guy is obviously a great danger to not just to the victim who's been identified in this case but to anyone else," said Bernalillo County Sheriff's Det. Kyle Hartsock.

Last month investigators arrested Joseph Martinez after a lengthy investigation. He already faced 441 years in jail for those charges, but investigators couldn't charge him for making child porn videos because the state statute of limitations had run out: Too much time had passed between the alleged crime and his arrest.

Investigators, the U.S. Attorney's office and the District Attorney worked with the FBI to get Martinez on federal charges to get around the statute of limitations.

On Tuesday, a federal grand jury came back with an indictment: two counts of manufacturing child porn.

He now faces 30 years in addition to the potential state sentence.

Martinez is accused of molesting the son of one of his employees. At the time of his arrest Martinez worked as the vice president and part owner of Accustripe, an Albuquerque company that paints lines in parking lots.

A couple weeks ago a judge lowered Martinez's bond from $1,000,000 to $100,000, said Hartsock. The judge cited Martinez's lack of criminal history.

Investigators said they also found two other boys on those tapes under the age of 10 who they are trying to identify.

Martinez is expected back in federal court Thursday for an arraignment.
