Cop shot man twice in the back

ALBUQUERQUE (KRQE) - An autopsy showed a man shot by an Albuquerque police detective in February was shot twice in the back and once in the buttocks.

Jacob Mitschelen, 29, allegedly pointed a gun at Officer Trey Economidy III during a traffic stop on Feb. 9.

The state office of the medical investigator said the wounds to Mitschelen were on his left, upper back, his left, mid-back and his left buttock. They were fired from an "indeterminate range."

Albuquerque Police say the autopsy report does not tell the whole story. They say Mitschelen did not have his back completely turned to Economidy.

"It's not in the side, but it's not quite in the back either," Dep. Chief Paul Feist said.

APD also said that Economidy was not running away from Economidy.

Economidy said Mitschelen fled from him when the officer pulled over his car. He said, during the fleeing, a gun fell from Mitschelen's clothing when he stumbled. Mitschelen picked it up and pointed it at Economidy. It was at that point that the officer fired.
