ALBUQUERQUE (KRQE) - Police responding to a child-welfare check found more than just children in the house, they found marijuana growing there too.

Today the boy's mother, Manuela Gutierrez, faced a judge on child abuse and drug distribution charges.

Police say the 5-year-old lived with Gutierrez and her boyfriend.

Inside the apartment officers say they found several pot plants, potting soil and lighting equipment for the illegal operation.

Gutierrez tried to tell the officers her boyfriend had a license to grow, but he failed to prove it to police.

Police say marijuana was already bagged in one room, totaling three pounds of pot.
