APD: Noisy kids irked man who attacked

ALBUQUERQUE (KRQE) - The man accused of attacking a girl waiting for a school bus just wanted pesky kids off his lawn, according to a criminal complaint filed in the case.

Victor Anaya, 47, remained behind bars Thursday on a no-bond hold.

On Wednesday morning four Montezuma Elementary School students were waiting for the school bus off Lafayette Drive NE.

Investigators say they were playing in the parking lot and lawn of an apartment building when Anaya came outside and started cursing at the kids telling them to get lost.

When they didn't Anaya apparently demanded the kids give him their backpacks and caught a 10-year old girl as she tried to run away.

Police allege Anaya then cut the girl's leg with a pocket knife and took her backpack.

The students told another mother what happened, and she went over to the apartment and got the backpack back before the students went off to school.

Albuquerque police department detectives caught up with Anaya at his apartment but only got a partial confession.

"While he admitted to yelling at the children, he never admitted, at least not initially to detectives, that he took the backpack," Officer Tasia Martinez said.

Anaya is charged with aggravated battery and robbery with a deadly weapon as well as child abuse. His police record includes charges from domestic violence and DWI to shoplifting and driving without a license.

Wednesday's incident led to another problem.

The city determined the apartment complex where this all happened doesn't have gas service.

The landlord was cited for renting out apartments without working utilities.
