ALBUQUERQUE (KRQE) - Police arrested Rose Montano, 32, when she allegedly caused a three-car accident. She was intoxicated while driving around her two children according to police reports.
Police first discovered Montano on July 3 when they saw three cars were involved in a wreck. Two of the drivers blamed Montano for the wreck to police.
While talking to Montano, the police officer said he saw a 5-year-old and 7-year-old in the back seat. They were buckled with a safety belt, but were not in child restraints, which is not legal for children of that age.
The police officer continued talking to Montano and thought he smelled "a strong odor of an alcoholic beverage coming from her..." When asked if she had been drinking, Montano allegedly responded "I had two shots earlier."
The officer conducted a field sobriety test on Montano, of which she performed "poorly" according to reports. He arrested Montano. Montano faces a felony charge of child abuse without great bodily harm and a misdemeanor charge of cruelty of a child. They have not charged her with driving while intoxicated.
