Alleged molester incompetent for trial

SANTA FE (KRQE) - The charges against a Santa Fe man accused of victimizing 15 boys have been dismissed, for now.

Santa Fe Police say Jacob Pinto has likely been targeting boys since 1989.  But it wasn’t until last year when authorities filed charges.

Authorities uncovered a videotape showing a teenage boy lying on the floor of Pinto’s home with his shirt off.  In the video you can see money lying next the boy and an egg timer ticking away.

Police told KRQE News 13 that they believed the egg timer was used to time how long the teen needed to be exposed, so that Pinto could satisfy himself.

After authorities filed charges, police found evidence of at least 14 other potential victims .  The evidence included photos of shirtless boys taken at the Santa Fe swimming pool, a local school, gym and park.  They also found magazine clippings of young boys with their shirts off.

Pinto was arrested and charged with criminal sexual contact of a minor, kidnapping, bribery, hiring a child for prostitution and contributing to the delinquency of a minor.

Now all charges have been dropped after Pinto was found “Mentally Retarded” and incompetent to stand trial. 

If Pinto is ruled incompetent and dangerous, then he could be sent to the State Mental Hospital until he is ruled competent to stand trial.  Although, if he is not found to be dangerous he will likely remain free. 

While the charges have been dismissed, they could still be re-filed.

Prosecutors in the case would only tell KRQE News 13 that the case was ongoing and would not comment further.
