Accused baby killer in U.S. illegally

ALBUQUERQUE, N.M. (KRQE) - News 13 has learned the man accused of raping and killing his 1-month-old baby should not have been in the U.S. in the first place.

An MDC spokeswoman says Juan Galindo, 33, was sent back to Mexico in July after serving time in jail on drug charges, a spokeswoman for the Bernalillo County Metropolitan Detention Center said.

Galindo goes by several names, including Oscar Valladez. Police say he raped and brutalized his baby girl Thursday morning, but it took hours before anyone called for help.

News 13 has obtained the criminal complaint in the case and the recorded 911 call from early Thursday morning.  They provide this account of what allegedly happened Wednesday night into Thursday morning:

Galindo told investigators he had doubled his usual daily dose of meth Wednesday night when he was looking after the baby.

He told investigators he heard the baby choking, so he patted her on the back. His demonstration to detectives looked more like a punch or strike.

Deputies said the baby had several injuries including black eyes, a damaged liver and injured genitals.

Galindo's 13-year-old daughter wanted him to call for help, but he told her, "No.  They will think I did it."

Three hours passed before the baby's mother came home from a casino. Deputies said she waited up to a half hour before calling other family members to the home. They in turn called 911.

A 911 dispatcher tried to instruct the family on how to give the baby CPR, but the baby was dead and already cold.

Deputies say it appears the infant also had injuries that may have happened before her death Thursday.

Galindo has been charged with aggravated criminal sexual penetration and child abuse resulting in death.
