Tainted yogurt suspect in federal court

ALBUQUERQUE (KRQE) - Anthony Garcia, 32, is charged with two federal felony counts that could send him to prison for eight years.

The Albuquerque man allegedly gave a customer a yogurt sample laced with his semen when he worked at Sunflower Market in January.

He went before a federal judge for the first time Thursday morning on charges of  adulteration of food which carries a maximum sentence of three years in prison. The second count is for lying to law enforcement which has a possible sentence of 5 years. Both carry fines of up to half a million dollars.

Agents from the U.S. Food and Drug Administration along with Albuquerque police arrested Garcia Wednesday afternoon.

On Thursday, the judge granted the federal attorneys request that Garcia remain in custody agreeing that he's a flight risk and a danger to the community.

The woman who ate the yogurt is suing both Garcia and Sunflower Market for hiring him.
