ALBUQUERQUE (KRQE) - One of the two teenagers charged with killing their foster mother in San Patricio will now have to go on trial in March.
The Alamogordo Daily News reports that this came after her plea agreement was found to be illegal.
In a plea agreement with the state, 16-year-old Desiree Linares was supposed to plead no contest to murder among other charges and in return the state would not seek adult sanctions.
However, authorities say first degree murder is an automatic adult conviction.
If a new plea agreement is not reached, Linares will be tried as an adult according to the Daily News.
Linares and Alexis Shields, now 16, are accused of smothering Evelyn Miranda two years ago.
