LOS LUNAS, N.M. (KRQE) - An Army Sergeant from Los Lunas is suing the Railroad after a train hit a truck carrying him and other wounded vets in a parade.

A Union Pacific Train freight crashed into the float at a Midland, Texas grade crossing earlier this month, killing four and injuring sixteen.

Sgt. Richard Sanchez was among the injured, is back was broken in the crash, and he may never walk again.

Sanchez along with another vet and both their wives say the Railroad was negligent and there was no timely warning that the train was approaching.

Federal investigators say the driver of the float entered the crossing even though lights were already flashing.
