State to work with Garduño's

SANTA FE (KRQE) - During a tax hearing on Tuesday, a judge ordered an injunction against Garduño's Restaurants to stop them from operating, but the state and a restaurant spokesperson said they're working out their differences.

Tortilla Inc., the owner of the New Mexico restaurant chain, never denied that it owed taxes to the state, but had disputed some of the penalties levied against it.

A spokesperson for the restaurant chain said the company will start making payments on what it owes, and the state confirmed that it will allow the chain to continue operating when the payments begin.

It's not immediately clear how much the chain will pay back, but it owes $740,533.07 in back taxes, plus penalties. If all of the penalties remain, the chain owes a total of $940,941.11.

The judge's shutdown order is expected to be filed within 10 days.
