Question submitted 11/19/2010:
What are the laws, regulations, and requirments when it comes to a minor trying to get emmancipated?
Answer from Kathleen Carter of Carter & Valle Law Firm:
The answer to your questions about emancipation of a minor can be found in the NM statutes, section 32A-21-1, until the end of that section. A Petition for Emancipation must be filed in Children's Court in Bernalillo county or the District Court in the other counties. You can go on-line and type in Conway Greene Co. - New Mexico which will get you to the statutes you need to review. The minor must be at least 16 and self-supporting, and there are other factors the judge will consider in determining whether emancipation is in the minor's best interest. The judge will hold a hearing on this matter to take evidence, and the parents must be notified.
