Question submitted 11/08/2010:
My 17 year old son had been working at Sonic for 2 years. He interviewed for a position at Kohl's and was hired. He gave his notice at Sonic, but has yet to hear of a start date from Kohl's. We've contacted Kohl's upper management and was told everything from his application feel throught the cracks to his references could not be reached. The latter is not true because we actually took one of his references to the location he was hired to work at and he told them that he did speak to someone.. Meanwhile...my son is unemployed and does not qualify for unemployment. I am so upset over this because we are a low income family and every little income to our household is important. Please advise me on what to do.
Answer from Rich Valle of Carter & Valle Law Firm:
From your facts, I assume your son can not go back to work at Sonic. He, under your facts, detrimentally relied on affirmations made by Kohls. Lawyers always like these things in writing, because we can determine what happened. The NM Department of Labor looks at these things and a complaint to them is what I recommend. I would say that it is just as likely that Kohls will say he was never hired and owe him nothing. Next time, get an employment offer letter from any prospective employer before leaving present employment.
